LSW advised in the preparation and realization of investments involving the construction of new energy sources and the construction of coke oven batteries. LSW supported the Client both at the stage of choosing investment location and design assumptions.
Creating analyzes and legal opinions as part of ongoing advising for energy companies:
We prepared a series of legal studies on disposal / acquisition of rights to energy infrastructure, LSW also carried out legal audits for energy grids for Gdańsk Shipyard SA, Huta Czestochowa Sp. z o.o., Koksownia Nowa and Polenergia S.A. LSW also advised its clients in commercial transactions relating to network infrastructure with particular regard to the ownership of land and easements transmission. Participation in business negotiations, assistance in concluding economic contracts:
LSW advises Client on amendments to the energy law, provides consultation and participates in negotiations with Client’s trading partners. LSW advised clients on such matters as the existence of the obligation to establish a reserve energy seller, and on the development of procedures for changing energy supplier. We have prepared legal analyses of transmission operating and distribution, and the TPA rule which applies to the big players in the shipbuilding and steel market, who lead licensed businesses as energetic entrepreneurs. Trading and distribution of electricity and licensed activity:
The scope of action undertaken by LSW in this case consisted of a comprehensive legal analysis of the licensed activity performed by the Client involving the trading and distribution of electricity, in the context of a complex legal situation of these networks in itself. The Client, while performing a licensed service, was not the owner of the network, through which the licensed activity was done. The LSW lawyers’ help was based mainly on the possibility of cessation of licensed activity despite the legal public obligation the Client had.
Consultancy on licensed activity:
LSW advises Clients - leading licensed businesses in trading and distribution of electricity, and trading and distribution of gaseous fuels. The firm has represented Clients in proceedings before the President of the Energy Regulatory Office on the territorial limits of concessions and in regards to ending the licensed activity, as well as in proceedings brought by the customer. The firm has represented Clients in negotiations with existing customers, as well as preparing agreements concerning the trading and distribution of electricity and gas fuels, connection and sale of electricity.
