From 26 June 2019, it will be possible for a non-farmer to buy up to 1 hectare of agricultural land.
On 27 May 2019, the President of the Republic of Poland signed the Act of 26 April 2019 on amending the Act on shaping the agricultural system. The Act will enter into force within 14 days from the date of its announcement, i.e. 26 June 2019.
- The amendment liberalises the previous strict rules for the acquisition of agricultural real estate, which have been in force since 1 May 2016. The acquisition of agricultural real estate of less than 1 ha will not be subject to the rigour of being an individual farmer.
- In addition, the obligation to run an agricultural holding on the purchased agricultural real estate for 10 years from the date of its purchase (after the amendment this obligation has been reduced from 10 to 5 years) will be abolished if the agricultural real estate has an area of less than 1 ha and is located within the administrative borders of a city.
- Also of significance is the fact of excluding from the right of pre-emption shares and stocks in capital companies which are owners or perpetual usufructuaries of agricultural real property with a total area of less than 5 ha.
